GENERAL DATA

The company ARTICLE TEN SRL, with legal office in Voluntari, Pipera Boulevard No.1, Ilfov County, Romania, registered at the Trade Register under no. J23/5480/2019, with Tax Identification Code RO41997370 as (“Operator” or “Data Operator”), processes your personal data in accordance with (EU) 2016/679 Regulation of the European Parliament and Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing the 95/46/EC (“GDPR”) Directive and the provisions of Romanian legislation governing personal data protection.

WHAT PERSONAL DATA CATEGORIES DO WE OPERATE?

1. The technical access data that your browser automatically sends to our server, as a result of accessing the website - the date and time of access, the content of the request (addresses and file names requested), information about the browser used and operating system (versions, language settings), online identifiers (for example: IP address, device identifiers, session IDs), possible error messages (if the requested content cannot be displayed).

2. Cookies set by us or cookies from third party providers. Cookies allow the local storage of information, such as language settings, the contents of the shopping cart and temporary identification features, which can be queried on subsequent site accesses in order to reload those settings. 3. When registering a customer account, as appropriate – name, address, date of birth, telephone number, e-mail address, payment details, order information (ordered products, item numbers, size data) and other information (e.g., products from the references list).

4. When ordering an Online Store product – information about the ordered products, such as item numbers and size, e-mail address, billing and delivery address, payment details, return and complaints details, order numbers, tracking numbers of orders’ shipment by transport service providers.

FOR WHAT PURPOSE DO WE OPERATE THE DATA?

  • Agreement execution (processing orders, solving agreement withdrawal requests or respectively, problems of any kind related to an order, purchased products, products return operation/registration and reimbursement, according to legal provisions, etc.);
  • Marketing and advertising;
  • Legitimate interest’s protection;
  • Legal obligations (e.g., financial-accounting management).

HOW LONG DO WE KEEP THE DATA?

We store the Data only for the period necessary to fulfil the purposes, taking into account prescription terms, applicable legal archiving terms, our legitimate interests.

You may ask us at any time to delete certain information or close your account (as applicable), and we will respond to such requests, subject to certain information retention, where required by applicable law or our legitimate interests.

HOW DO WE PROTECT DATA?

We apply appropriate technical and organizational measures to ensure Data Protection in order to prevent, inter alia, data sharing with unauthorized persons, data retrieval by an unauthorized person, their processing in violation of applicable laws, and Data change, loss, damage or destruction. External disclosure of information on technical and organizational measures applied to operation protection may compromise effectiveness, which would jeopardize the adequate Data protection.

TO WHICH RECIPIENTS CAN WE TRANSFER THE DATA?

As a rule, we only transmit your personal data to other entities when:

  • you have expressly agreed in accordance with GDPR Article 6 para. 1 letter a;
  • in accordance with GDPR article 6 par. (1) letter (f) submission is necessary for validation, exercise or defence of legal rights and there is no reason to assume that you have a superior legitimate interest in opposing your data transmission;
  • we have a legal obligation to transmit the data, in accordance with article 6 par. 1 letter c or e of the GDPR, in particular where there is an obligation to disclose to an authority;
  • the transmission is legally permitted and necessary in accordance with GDPR Article 6 para. (1) letter b, for the purpose of carrying out contractual relations with you or for initiating pre-contractual measures, at your request.

Part of the Data Operation procedure described in this Personal Data Protection Policy may be performed on our behalf by external service providers (e.g., courier companies in connection with the forwarding of shipments, companies providing electronic communications services related to electronic communication, to banks in payment transactions connection, etc.).

If we transfer data to our service providers, such providers may use the data solely for the purpose of providing those services. Your data operation by the designated service providers takes place during the processing of orders in accordance with GDPR Article 28. Service providers are carefully selected and designated by us.

The operator does not intend to transfer your personal data to a third country (outside the EU) or to an international organization.

WHAT ARE YOUR DATA PROTECTION RIGHTS?

  • The right to be informed, mainly about Operator’s identity and contact details, the purpose for which the Data are processed, operation’s legal basis, the recipients and Operator’s intention to transfer or not the data to a third party;
  • The right to access personal data;
  • The right to correct or intervene in any personal data;
  • The right to have your personal data deleted/destroyed;
  • The right to limit your personal data processing;
  • The right to have data portability;
  • The right to object;
  • The right not to be subject to a decision based solely on automatic processing, including profiling, which produces legal effects concerning the data subject or similarly affects him to a significant extent;
  • The right to lodge a complaint with a supervisory authority.
